Lawyers & Attorneys
Lawyers are people trained in aspects of law who may represent clients in court; they are called attorneys in The United States and on some occasions, advocates or advisors. When a lawyer enters the courtroom to represent a client they are called an advocate; for many, this is not something they wish to pursue, passing over cases to others that prefer this type of legal representation. Not every situation requires representation and quite often they are employed as legal advisors; this occurs when a client merely wants help on a legal matter or guidance in how to proceed in a case.
Trial lawyers have greater familiarity with courtroom rules and strategy; owing to the fast thinking that is required by those who practice this area of law, it is not for everyone.Trial lawyers actually spend more of their time outside the court; they perform their own investigations into the case in addition to other trial procedures including talking to witnesses.
The legal system affects nearly every aspect of our society; it affects everyone’s life from negotiating a house purchase to organizing a will and the reason why lawyers are governed by a very strict code of practice. The more detailed aspects of their position depend upon his or her field of expertise; but all are licensed to represent parties in court when necessary.
Today’s life and law is becoming ever more complex creating new subject areas for the legal system to practice in; more exist so not all are listed here:
- Constitutional Law
- Insurance
- Environmental Issues
- Adoption,
- Identification Theft
The number of specialist areas of law is also the reason why only a few ever practice in a courtroom!
Those specializing in environmental law for example might watch out for the interests of organizations on either side of the argument; an example of this group could be:
- Construction Firms
- State agencies
- Land Developers
Representatives in this field may be arranging for their clients to carry out certain actions; they might also represent a company in a civil action resulting from work they have already undertaken.
Of course one of the cleaner areas that attorneys are involved with is intellectual property rights; it covers digital images, songs and videos; in fact anything that is available on the internet. Major insurance companies usually employ lawyers in their legal department; insurance contracts and claims are often investigated which is an are where their expert knowledge will be invaluable.
Much of law might be considered mundane as the majority of attorneys carry out their work in private practice involved with minor criminal and civil law. criminal lawyers represent people charged with crimes whether for defense or prosecution; civil law assists clients experiencing litigation problems with wills, trusts, contracts, mortgages, titles, and leases for example.
Another high profile legal position is in cases where the public interest is served; these might concern large companies for example where their image might be at risk. A few lawyers decide to use their knowledge to help the defense and rights of those less fortunate in foreign countries; this aspect of legal assistance is often frowned upon but it is a dignified use of a person’s legal skills.
